Terms and Conditions
Please read the following terms and conditions (Ts&Cs) as they are the basis of the contract between you and Swim With Cheryl. For the purposes of this agreement, ‘You’ includes the person making the booking, the person attending the course, lesson or session and where relevant the parent or guardian. You agree to our terms and conditions when singing up and paying for lessons.
Bookings and Payments
Our course dates are emailed to you at the start of the course. Weekly lessons run for 11-16 consecutive weeks, depending on the school term dates. Intensive lessons (‘crash courses’) run over 4 or 5 consecutive days.
Bookings are only confirmed once payment has been received. Payment deadlines will be communicated but are a term in advance for weekly bookings and provided payments are received by the payment deadline, the space will be held to allow the current swimmer to rebook.
In the event the payment deadline is missed, the space will be released and will be available to be booked by another customer.
Intensive courses are bookable and spaces are allocated based on when payments are received.
If a swimmer joins part way through a course, a pro rata payment, relative to the remaining lessons, will be due in full for sessions left on the course.
Payments must be made by bank transfer and must be made in full. Any part payment will not secure the booking. Cash payments will be accepted for renewals only, these payments must be given to the Poolside Supervisor only.
Cancellations/Refunds
There is a 14 day window after payments have been received for a refund to be requested provided this is more than 14 days before the start of the course. This allows a reasonable opportunity to resell the space. If you wish to cancel a booking for a course after payment has been made, this request must be by email to swimwithcheryl@hotmail.com and must include the reason for the cancellation. Please note an admin fee will be taken for having to re-sell your space (admin fee charged at £30.00).
Refunds will be processed within 14 days of receipt of the email and payment will be made online to the account from which the payment was received less a £30.00 administration charge per swimmer.
Up to 6 weeks before a course starts, we are unable to refund payments for cancellation of the course.
Missed lessons including any illness, injury or holidays as we have a commitment, in advance, to the teacher and for group sessions that the class will continue. However, if a pupil suffers a serious illness or injury which affects their participation for more than 6 weeks (such as a broken bone or prolonged hospitalisation) we may offer a part refund for lessons missed provided you notify us at least 48 hours before the first lesson missed, provide us with a medical note detailing the illness or medical condition and you accept that we may offer the space to another participant; we will endeavour to offer you another suitable slot when you are ready to return.
Refunds will not be given for lessons missed due to adverse weather conditions in your locality if the venue and environment are accessible and the lessons can go ahead.
It does sometimes take new swimmers a few lessons to settle into the programme. If after 3 lessons, Swim With Cheryl feel that it is in the swimmers interests to terminate the course at the current time, the remainder of the course fee will be refunded, minus the administration fee above.
Bookings are non-transferable to others.
If you have any concerns about a class or teacher, please let the Poolside Supervisor know immediately or alternatively email us at swimwithcheryl@hotmail.com at the earliest opportunity so that we can resolve your concerns.
Cancellations by Swim With Cheryl
Classes may be cancelled at short notice if the pool is not fit for teaching purposes.
If for any reason, Swim With Cheryl are unable to provide a class, a replacement class will be scheduled. Details will be communicated to you, giving at least 7 days’ notice of the replacement class. No refunds will be offered if you are unable to attend the replacement session. In the event it is not possible to arrange a replacement class, a refund for the session will be made within 14 days of the end of the course.
Swim With Cheryl will endeavour to give you as much notice as possible in the event that a class is cancelled.
If there is insufficient support for a course, we reserve the right to cancel, suspend or postpone a course before the first lesson. We will give you as much notice as possible and we will refund your payment in full if no suitable alternative can be provided. Any liability will be limited to the course payment only.
Medical conditions and Illness
You will be asked to declare any existing medical conditions when you register. Please inform us of any changes to medical conditions, including pregnancy, as soon as you are aware so that reasonable adjustments can be made as necessary.
If you have a contagious illness such as an ear infection, flu, diarrhoea, vomiting, chicken pox, impetigo, conjunctivitis or a bad cold, please wait until your doctor has given the all clear for you to swim. In instances of vomiting or diarrhoea you must have been clear of the symptoms for 48 hours before attending a session.
People with any symptoms of Covid-19 are not to attend swimming lessons and family members should also not attend sessions. No refund or replacement lessons will be given if you have to self-isolate.
People with symptoms of cryptosporidiosis should not use a swimming pool for 14 days after the symptoms have cleared.
People with athlete’s foot are not allowed in the swimming pool or surrounding area unless their feet are suitable covered.
Verrucae socks must be worn if a person is suffering from verrucae(s).
If you are ill, please inform us at the earliest opportunity so that we can notify the teacher.
Instructors
We are not able to guarantee a particular instructor for a class or course and instructors may be changed on a temporary or permanent basis once a course has started. We deliver the Swim England framework and all instructors will grade your child in accordance to this. You are welcome to ask for feedback at any point of the course.
Treatment of Staff
You agree to treat all staff with respect and dignity.
Under no circumstances are you to abuse staff. Any incidents of abuse towards staff will be dealt with and you will be asked to leave the premises and legal action may be taken against you. We reserve the right to cancel your booking with Swim With Cheryl without refund if you are found to have abused staff members in any way.

Supervision
Parents or guardians are responsible for children that they bring to lessons from arrival on site, supervision in the changing rooms and in any part of the facility.
You must not leave the pool or surrounding areas whilst your child is in the pool. In the event that your child needs to go to the toilet during a lesson, the teacher will ask you to supervise them.
Swimmers must not enter the water until instructed to do so by the instructor.
You are responsible for your child until the teacher collects them at the start of the lesson and you must collect your child, promptly, at the end of the lesson.
Parents and guardians must spectate from the outside. We do not allow parents or guardians on poolside as it distracts the swimmers.
Please refrain from communicating with or distracting the teacher or lifeguard during lessons or after sessions. Any questions should be directed to the pool supervisor or you can email swimwithcheryl@hotmail.com.
Children who are not participating, are asked not to attend. If you must bring another child due to child care issues, you must supervise your child at all times.
SWIMWEAR
All children and adults attending swimming lessons MUST wear swimming hats and goggles, which if required can be purchased through Swim With Cheryl.

Health & Covid-19
If you or a member of your household have a cold, fever, anosmia or any signs or symptoms of COVID-19 you should not enter the swimming facility or attend swimming lessons. You should self-isolate for two weeks and please do not attend swimming lessons for two weeks.
According to the scientific literature, there is no increased risk of contracting COVID-19 from swimming in chlorinated pools. Further, the US based Centre for Disease Control and Prevention (CDC) suggests that there is no evidence that COVID-19 can be spread to people through water in pools but individuals need to continue to protect themselves and others both in and out of the water through following appropriate social distancing measures and good hand hygiene practices.
Any swimmer / parent / guardian / teacher / that has travelled overseas must adhere to that country's guidelines of what is acceptable regarding isolation.
Any swimmer / parent / guardian / teacher that has been in contact with a confirmed case of COVID-19 must self-isolate for 14 days;
Any swimmer /parent / guardian with symptoms or signs of COVID-19 (see below) MUST NOT attend the Swim School until full recovery has taken place;
Symptoms of COVID-19 can range from mild illness to pneumonia. Some people will recover easily, and others may get very sick very quickly.
People with coronavirus may experience symptoms such as: Fever Coughing Sore throat Shortness of breath Loss of taste or smell Temperature above 37.5ºc Fatigue Unusual muscle aches and pains Diarrhoea.
Viewing
All swimming pools are being encouraged to reduce spectators. Therefore we ask that no parents are poolside unless your child has a medical condition.
Please check that we have the correct telephone number for you, if an incident was to occur you will receive a phone call from poolside for you to return to the building.
Parents/guardians must stay in their cars or where it is safe to stand (please do not stand in middle of car park)
Parents/guardians will be required to wear facemasks.
Changing Rooms
Swimmers will arrive “Beach Ready” and will not use the changing room on entry.
Do not shake any towels or clothing items as this could put the virus in the air.
Swimmers will be encouraged to shower at home as the showers will be out of order.
On exit, the changing rooms will be available, but everyone must keep to social distancing, if the changing rooms are busy please wait for them to become free.
Both changing rooms will now be unisex.
Changing is optional, swimmers can towel dry and put appropriate clothing over their swim wear before leaving. For example, a dressing gown or onesie over the wet swimming costume.
All swimmers over the age of 8 or who can change independently must not be accompanied by an adult to change, but meet their parent/guardian outside.
Parking
Please be aware that there is no parking within some of our venues and you may need to seek alternative parking
Please park on the road or surrounding areas and walk the short distance to the school if our venue does not provide parking
Please be considerate to neighbours of venues when you are parking
Arrival and departure
All swimmers arrive ready to swim (beach ready) . We suggest children come in robes or onesies over their swimwear.
Please do not come in earlier than 5 minutes before your scheduled lesson.
The accompanying parent / guardian will be limited to one person per swimmer and unless there is a medical condition we ask parents to wait outside
We ask that you do not use the school premises to loiter and please leave the school / swimming venue grounds as soon as possible once your lesson has finished.
Do not go anywhere else that you have no permission to enter - classrooms, playgrounds etc
Clothing
All swimmers arrive ready to swim (beach ready)
We suggest children in robes or onesies over their swimwear. Outside footwear must be removed before entering the pool area or covered with Shoe Covers – these must not be removed until outside of the building
Appropriate swimwear must be worn for those participating in lessons. We Advise shower shoes/ Crocs/ Flip Flops to be worn by children poolside
No jewellery is to be worn in the pool.
All children must wear hats and goggles.
If proper uniform is not adhered to the swimmer will not be allowed entry into the pool.
There will be NO SPARE hats and goggles to borrow due to covid-19
Goggles must be placed on the child's head before they enter the pool
Food, Drink & Personal
No food or drink is permitted poolside or in the changing rooms It is advised that children do not eat for a minimum of at least 1hr before their swimming lessons
Pushchairs are not permitted on onsite
Siblings of swimmers who are not within a swimming lesson will be asked not to attend.
Swim With Cheryl is not responsible for loss or theft of personal belongings and valuables.
General Data Protection Regulations (GDPR)
We collect the information requested during our sign-up process and any other forms completed for specific reasons that are necessary for your attendance.
By providing the information to us, you:

Give permission for the personal and contact information to be held by Swim With Cheryl for use where necessary to contact you and oversee your safe attendance at Swim With Cheryl.

Give permission for your contact email address and or mobile phone number to be used to provide all necessary information for future events, promotions and advertisement purposes relating to Swim With Cheryl.

Agree to update Swim With Cheryl should any of the contact or medical information you have provided change and needs updating.

Understand that Swim With Cheryl will retain my information until your ‘membership’ has elapsed for one calendar year.

Please let us know if you would like your data permanently deleted from Swim With Cheryl records at any time.
General
You may not take photographs or video recordings during lessons unless this has been pre-agreed with Swim With Cheryl Swim School. In addition, consent from everyone who is in the photo or video is required prior to taking any photos.
Children must not be fed for 1 hour before their lesson (45 mins for milk/fluids).
If your child is not toilet trained, please ensure that they wear a suitable swim nappy under their swimming costume. Please take all your used nappies away with you. Please do not dispose of them in an open bin on the premises.
Children must go to the toilet before their lesson.
Long hair must be tied back or a swim cap must be worn.
Goggles may be used but we reserve the right to remove them if they are hindering the swimmer or class.
Shoes must be removed before going on poolside or in changing rooms (or overshoes must be worn).
Buggies must not be taken onto poolside.
Any property left outside, in the entrance hall, changing rooms, the spectator gallery or on poolside is at your own risk.
Please remove all jewellery before entering the water.
Glass items, crockery and other such items must not be taken onto poolside.
There is a no smoking policy on site and the consumption of alcohol is not permitted.
Dogs are not permitted on the premises nor in the grounds of the school.
All pool rules MUST be followed at all times.
We reserve the right to vary these terms and conditions at any time upon reasonable notice to you.
Changes will be advertised and made directly to the website.
